Requirements
Carrying a motorcycle passenger: helmet and approved seat
Carry a passenger only if the vehicle is approved for two, has the intended seat, and the passenger wears a compliant helmet.
Carry a passenger only when the vehicle is approved for two people and has the designated seat; both driver and passenger must wear an approved, fastened helmet.
Check the authorised passenger seat first
A long saddle or the presence of footrests alone does not prove that a vehicle is approved to carry a passenger. Check the registration document and approved configuration for two seats. The passenger must sit in a stable, balanced position on the seat provided by the vehicle's equipment; they may not sit sideways, on an area not intended as a seat, or in a way that interferes with the driver.
For two-wheel mopeds, article 170 also requires the passenger seat to be expressly listed in the registration certificate and the driver to be over 16. Do not apply that moped-specific rule indiscriminately to every motorcycle: check the vehicle class and documents. Even with an approved seat, do not exceed the authorised passenger count, and make sure the passenger can mount, dismount and hold on correctly.
The helmet remains mandatory for both people
The driver and passenger must wear a helmet that complies with approved types and keep it properly fastened while riding. Having an authorised seat does not replace the helmet requirement, and a non-approved helmet does not become acceptable because the trip is short. Before departure, check that both helmets fit, their straps are closed and the passenger can sit securely.
If the vehicle document does not list a second seat, do not carry someone even if there appears to be room. For example, a motorcycle with an extended saddle but approved for one occupant does not become a two-seater just by adding footrests.
