Fine involving licence points: who must identify the driver?

If the driver was not identified at the roadside, the vehicle owner must provide their details by the deadline in the notice.

When an offence carrying a points deduction is not directly attributed to the driver, Article 126-bis requires the vehicle owner or other responsible party to give the police authority the personal and licence details of whoever was driving. Paying the fine does not replace this communication.

Identify the driver and follow the request

If a notice for an offence that carries points is sent to the vehicle owner and the driver was not identified at the time, the owner must provide the requested details to the police authority that recorded it. Follow the deadline, form and channel stated in the notice; the communication concerns the person who was driving at the time, even if they are not the vehicle’s registered owner.

The driver-identification step is separate from payment of the monetary penalty. Paying the fine does not say who was driving and does not transfer points to the owner. If several people used the car, establish who was driving and provide accurate information rather than naming someone for convenience. If you have a reason you cannot identify the driver or are unsure how to respond, contact the issuing authority before the deadline.

Keep proof and distinguish the consequences

Send the information through the specified channel and keep the receipt, a copy of the form and the notice reference. Points are assigned to the licence of the identified driver, and the record is updated under Article 126-bis. The owner who fails to provide details may receive a separate notice; that consequence is not a deduction from the owner’s licence.

This article does not state a fine amount for non-compliance: it can change and must be checked in the current law and notice. If you appealed the original offence, read carefully what the notice says about the deadline for providing driver details; the applicable procedure may link timing to the outcome of the case. Ask the issuing authority rather than assuming that payment or an appeal removes the obligation. Keeping the correspondence helps show that you responded correctly.

Frequently asked questions

If I pay the fine, must I still identify who was driving?

Yes. Payment and driver identification are separate requirements when the driver was not identified at the roadside.

Are points taken from the vehicle owner?

No. Points are deducted from the identified driver’s licence; failure to provide details may lead to a separate notice.
