Category C1 with code 97: which vehicles are excluded?

Code 97 restricts eligible vehicles

MIT provides for a C1 licence with harmonised code 97, which restricts driving to vehicles not subject to tachograph installation and use requirements. C1 still covers vehicles above 3,500 kg and up to 7,500 kg within its passenger limits; the code adds a condition concerning the vehicle and its regulatory status.

Read the back of your licence and identify the code shown. Do not assume a truck is allowed just because you plan to move personal belongings or the journey is short. Tachograph requirements depend on the vehicle’s characteristics, use and specific legal exemptions; private use is not automatically an exemption. If the classification is uncertain, check with the relevant authority or a transport adviser using the vehicle documents and the actual purpose of the trip.

Check the vehicle, purpose and records

Before driving, check maximum authorised mass, vehicle category, intended use and whether the vehicle falls within tachograph rules. Exemptions are limited and can depend on the activity and conditions of use; the phrase “private use” in a conversation or advert is not enough. Keep documents on board that show the vehicle’s characteristics and the reason for transport if required.

For example, a C1 vehicle with code 97 may be driven when the vehicle and use fall outside tachograph obligations; if the transport is part of an activity subject to those obligations, the restriction may prevent its use. Code 97 is not a blanket ban on commercial vehicles, but you must establish that the specific case is permitted. Ask before accepting a job or renting the vehicle: C1 by itself does not resolve the tachograph issue.
