Can you drive a nine-seat van with a category B licence?

Yes, if the vehicle meets category B limits for mass and carries no more than eight passengers in addition to the driver.

Category B covers motor vehicles with a maximum authorised mass of 3,500 kg or less, designed to carry no more than eight people in addition to the driver. A van approved for nine seats in total may qualify if it also meets the mass limit.

Nine seats in total means eight passengers

The definition of category B allows a vehicle to carry no more than eight people in addition to the driver. A vehicle with nine seats in total, including the driver’s seat, can therefore meet the passenger limit. The word van does not establish its category: check the approval and official data for that particular vehicle.

The second condition is maximum authorised mass, which must not exceed 3,500 kg for category B. Check the vehicle certificate, the approved seat count and the stated mass. Do not infer the permitted number from seats currently fitted or from the fact that the vehicle is empty. If its authorised mass is over 3,500 kg or it is designed for more than eight passengers plus the driver, B is insufficient and you must identify the appropriate category. Classification can also depend on the vehicle’s approval and intended use.

Check use and conditions too

Even with the correct licence, you must respect the approved occupant limit, seat belts and conditions in the vehicle documents. A seat without a usable belt does not permit an extra passenger. If the vehicle is used for professional transport or a particular service, additional requirements or qualifications may apply: the licence category alone does not answer every obligation attached to the activity.

Before a journey, compare your licence, the vehicle certificate and the actual number of people. For example, nine occupants including the driver fit the category B passenger count only if the vehicle is approved for those seats and its maximum authorised mass is no more than 3,500 kg. If the documents show a different seat count, the approval and documents govern, not the seats you can arrange in practice. For an imported or modified version, ask the UMC to confirm its category before driving.

Frequently asked questions

With nine seats total, may I carry nine passengers in addition to the driver?

No. Category B allows up to eight people in addition to the driver, or nine occupants in total. The vehicle must be approved for that count.

If the van weighs less than 3,500 kg today, is category B enough?

The relevant figure is the maximum authorised mass in the vehicle documents, not its actual unladen weight on a particular trip.
